Process:

At the time of the incident, two construction vehicles were conducting work on the highway.

After arriving at the site, they parked one behind the other. A following bus, allegedly not paying attention, collided with the rear construction vehicle without braking. The force of the impact caused the rear vehicle to crash into the front construction vehicle.

Both vehicles were severely damaged, and both drivers sustained injuries. Inside the bus, multiple passengers were injured from the impact, either falling to the ground or hitting their seats. All injured individuals were immediately sent to the hospital or sought treatment on their own.

After the incident, the bus driver was charged with careless driving.
Subsequently, we represented the injured parties in seeking compensation from the bus driver’s insurance company. Both drivers received satisfactory compensation for their injuries and the repairs of their vehicles. Additionally, the injured passengers were compensated reasonably based on their varying injuries after recovering with our efforts.

Incident Description:

At the time, the light truck was traveling in the rightmost lane of Java Road, preparing to turn right onto Power Plant Street. Suddenly, a private car in the second right lane followed suit, aggressively colliding with the rear of the truck, resulting in neck and back injuries to the driver. The driver was subsequently taken to the hospital, where it was confirmed he had a minor neck fracture.

As the second lane was not permitted to turn right, the private car driver was later convicted of careless driving. The truck driver required 8 months of recovery due to the incident, during which he was unable to work, as his delivery job required personal involvement in handling and collecting payments.

After the trial and the end of his medical leave, with our assistance, the driver filed a civil claim for his injuries, loss of income, and vehicle repairs, and successfully achieved a satisfactory outcome.

Incident:

On the night of the incident, a taxi was traveling westbound on Argyle Street near Sai Yeung Choi Street South and allowed a passenger to alight in a restricted area. After the passenger alighted, the taxi intended to continue towards Nathan Road. As the taxi entered the pedestrian crossing, the traffic light turned yellow, and to avoid stopping at the pedestrian crossing, the taxi continued forward. At the same time, a private car, responding to the green traffic light ahead, entered Argyle Street from Sai Yeung Choi Street South. The taxi and the private car collided, causing the accident. The private car was damaged, and its driver was injured.

After the accident, the police investigated but did not charge either party with “careless driving” and only charged the taxi driver with “allowing passengers to board and alight in a restricted area.”

After being commissioned by the private car driver, we immediately conducted an investigation and analysis, and then filed a complaint with the police, urging them to reconsider charging the taxi driver with “careless driving.” However, the police ultimately insisted on not charging the taxi driver for the following reasons:
(1) The taxi driver technically did not violate the law by running the yellow light;
(2) The taxi driver’s decision to continue driving after the light turned yellow was reasonable to avoid stopping at the pedestrian crossing;
(3) Both vehicles had their views obstructed by pedestrians before the collision.

Despite this, our client was indeed injured and suffered property damage in the accident. We firmly believed that the taxi driver’s negligence caused the accident, even though they were not charged with “careless driving.” We persisted in assisting our client in pursuing compensation from the taxi driver.
Through our relentless efforts, we ultimately held the taxi driver accountable for their negligence, and our client received reasonable compensation.

Incident:

On the day of the incident, the taxi driver was driving along Kwai Chung Road towards Tsuen Wan in the second left lane. Near the incident location, the taxi driver changed lanes to the third left lane.

After fully entering the lane, the taxi was suddenly hit from behind by a private car traveling at high speed in the third left lane. The impact caused the taxi to crash into the right curb twice and overturn, resulting in damage. The taxi driver sustained injuries to the neck, waist, and limbs, the female taxi passenger injured her left leg, and the private car driver sustained chest pain.

The taxi driver received 29 days of sick leave due to the accident. With our assistance, the taxi driver filed a civil claim for his injuries, loss of income during the recovery period, and loss of taxi deposit. We successfully pursued compensation within two months of initiating legal proceedings.

Incident:

The client’s private car was parked on the roadside. The involved bus was parked at the bus stop behind to pick up and drop off passengers. When the bus moved out to the right, its left side collided with the right side of the parked private car. The bus driver was later convicted of careless driving.

The accident caused the client to suffer a neck injury. As the breadwinner of the family, the client faced continuous financial pressure during the sick leave period. The client expressed a desire to resolve the case quickly and was concerned about the high legal fees and lengthy legal procedures.

After understanding the details of the accident and the client’s instructions, we actively negotiated with the insurance company to handle the claim without compromising the client’s rights. Initially, the two parties could not reach a settlement regarding the loss of income, as the insurance company insisted that the client’s cash salary was not recognized even with income proof. Our solicitor cited different cases to prove that the other party could not blindly refuse to recognize the documents related to the case to protect the client’s rights.

Delivery Rider Injured on the Job Receives Fair Compensation

In the afternoon of October 2023, Mr. Ali (pseudonym), an Indian delivery rider, was delivering food on Song Huang Tai Road when a private car suddenly changed lanes and collided with his motorcycle, causing both the rider and vehicle to fall.

Mr. Ali was promptly taken to Queen Elizabeth Hospital’s emergency room, where it was confirmed that he sustained a back strain and wrist injury. The doctor advised him to rest for a week and referred him for follow-up physical therapy.

Mr. Ali has been working in Hong Kong for ten years, supporting his wife and three young children. The family’s living expenses rely entirely on his daily delivery work. After the accident, and worrying about a disruption in income, he only took three days off before returning to work. However, the continuous delivery work exacerbated his neck and back pain, and he even experienced wrist numbness, severely affecting his ability to work.

Incident Overview:

At the time of the accident, a taxi carrying two passengers was traveling in the leftmost lane, while a dumper truck driven by the defendant was in the second lane. As they reached the accident location, the dumper truck suddenly swerved left to change lanes from the second to the first lane, colliding with the taxi and pushing it onto the left shoulder of the road before coming to a stop. The accident resulted in injuries to the taxi driver and the two passengers, who were subsequently transported to the hospital by ambulance. Following the trial, the defendant was found guilty of careless driving.

Impact on the Taxi Driver:

Due to the accident, the driver sustained injuries to his neck and right shoulder, resulting in 6 months of sick leave. During this period, he was unable to work, leading to loss of income, along with additional expenses for taxi rental and parking fees. With our assistance, the driver successfully claimed for income loss and medical expenses prior to the case being brought to court, achieving a highly satisfactory outcome.

Impact on the Passengers:

The mother, a passenger, experienced back pain, while her 9-year-old son suffered an injury to his right forearm. After receiving treatment, both were issued 4 days of sick leave by their doctor. As a housewife, the mother could not provide proof of income loss. However, with our support, she ultimately secured a reasonable compensation amount.

The son, being a minor at the time of the accident, had his mother represent him in court to pursue claims, resulting also in a successful compensation outcome.

Incident Summary:

This was a three-vehicle collision. At the time, the private car driver represented by our firm was driving south along Tolo Harbour Road with his wife and child towards Shatin. Another private car and a light goods vehicle were following closely behind.

The light goods vehicle braked too late, colliding with the private car in front and pushing it into our client’s vehicle.

The accident resulted in neck injuries for both drivers and one of the passenger. Additionally, the young child passenger experienced dizziness and shock, and they all sought treatment either at private clinics or hospitals. Since the light goods vehicle driver was fully responsible for the crash, he was subsequently convicted of careless driving.

Our client, the driver of the private car, required three months of recovery following the accident. His wife, being a housewife, also had to take similar amount of sick leave. Despite suffering from neck pain, she still managed household chores and cared for their child, which was quite challenging. After the conclusion of the trial and their sick leave, the driver and his family, with our assistance, filed a civil claim in court for compensation for injuries and vehicle repairs, achieving a satisfactory outcome. The compensation for the child was also approved by the court and will be released upon his application when he turns 18.

Incident Overview:

The scene was at the intersection where the three-lane Kwun Tong Road merges into four lanes westbound towards Mong Kok. At the time, vehicle V1 was in the second lane from the left on the three-lane section. As V1 approached the merge, it needed to shift from the second lane to the fourth lane to exit towards Kwai Chung. However, upon nearing the fourth lane, V1 noticed a traffic accident ahead and decided to wait until it could safely pass the accident scene.

As V1 approached the accident location in the fourth lane, a vehicle that was originally in the fourth lane had to merge left into the third lane to avoid the blockage. Consequently, when V1 reached the accident site, an SUV (V2) merged into the third lane without properly assessing the traffic conditions, resulting in a collision with V1. This collision caused damage to the right side of V1 from the driver’s door to the rear, while the left front of V2 was also damaged, resulting in injuries to the driver of V1.

Police Investigation:

During the initial statement, the driver of V1 provided their account at the Traffic Department and submitted dashcam footage as evidence. After taking an interview record from the driver of V2, the police then requested V1’s driver to return for further questioning, indicating that he might face charges, turning the victim into the defendant. This left the victim feeling confused and uncertain.

Following a referral, the driver of V1 sought our legal advice. After analysing the dashcam footage, we concluded that the accident was not the fault of V1, but rather solely that of the driver of V2. Armed with this information, V1’s driver decided to file a complaint with the police to rectify the investigation direction.

As a result, V1’s driver was summoned again to provide additional statements to the Traffic Department. Within four months, both drivers provided statements to the department, which after an investigation decided to charge the driver of V2 with “careless driving.”

Post-Incident Analysis:

Hong Kong has an average of 1,800 traffic accidents per month, leading to a backlog at various police traffic divisions. In an effort to expedite investigations, the authorities may overlook critical details in the statements of both parties, which can lead to situations where the victim becomes the defendant.

Each traffic incident must be independently analysed, preferably by registered legal advisors experienced in handling such cases. If there are any perceived injustices during police investigations, it is crucial to seek legal advice and address those concerns with the authorities.

Incident:

On the day of the incident, the private car driver was transporting friends from the mainland along the single-lane Lung Yut Road in Tai Po. As they approached the incident location, the driver slowed down and maintained a safe distance due to a traffic jam ahead. Once the private car had come to a stop, a taxi behind failed to slow down or brake, crashing directly into the rear of the private car, resulting in neck injuries for both the driver and passenger.

After the collision, the driver exited the vehicle to assess the damage, while the taxi driver attempted to settle the matter privately for HKD 1,000. However, feeling significant neck pain and noticing damage to the rear of the vehicle, the driver declined the offer and reported the incident to the police.

Upon the police’s arrival, the driver was taken by ambulance to the hospital for treatment and was issued a sick leave for recovery. After the sick leave ended, the driver continued to experience persistent neck pain, and the passenger also began to feel discomfort, prompting both to seek further treatment at a private clinic. As a result of the incident, both individuals required approximately 4.5 months of recovery.

Once we took over the case, we immediately wrote to obtain necessary documents from the police, hospital, clinic, and notary office, and liaised directly with the opposing insurance company to manage the claim process. With our assistance, both injured parties reached a satisfactory settlement with the insurance company’s appointed claims representative before filing in court.

Incident Overview:

On that day, Mr. X, the owner of the private car, and the defendant public bus driver were driving along Ferry Street in sequence. As they approached the accident location, Mr. X and the private car driver stopped due to traffic conditions. However, the public bus driven by the defendant failed to stop in time and collided with the rear of the private car, pushing it forward and causing it to hit Mr. X’s vehicle. This resulted in a chain collision involving all three vehicles, leading to injuries to Mr. X’s neck and shoulder. The defendant was later found guilty of careless driving.

Mr. X required six months of recovery from the incident, during which he was unable to work and had to frequently visit hospitals and clinics for treatment. Our firm was retained by Mr. X to pursue compensation from the at-fault driver, including loss of income during his medical leave and vehicle repair costs.

Incident Overview:

On the day of the incident, the motorcycle rider, WP, was traveling east along Tin Wah Road. The defendant, driving a private car (YA), was following behind. As they approached the accident site, YA failed to brake in time and collided with WP’s motorcycle. This caused WP’s motorcycle to crash into a private car in front (VS), which then pushed VS into another private car (SW), resulting in a four-vehicle collision with injuries.

The incident resulted in WP’s motorcycle being completely destroyed, and he was unfortunately thrown off the bike upon impact. Bystanders assisted WP to the roadside.

Although he appeared conscious, he had visible injuries on his neck, right side, and left calf. When police and paramedics arrived, they immediately attended to WP. He was taken to Tin Shui Wai Hospital for treatment and subsequently transferred to Tuen Mun Hospital for orthopaedic care due to a fractured calf. Thankfully, VS and SW only sustained damage to their vehicle bodies.

Legal Proceedings:

After the police investigation, they reviewed dashcam footage from vehicles YS and SW, which clearly showed that YA’s failure to brake caused the four-vehicle collision. YA was charged with careless driving and fined HKD 1,200, demonstrating his legal liability.

Compensation Recovery:

During his hospitalization and recovery, WP was unable to work, leading to significant income loss. After the court hearings and completion of his medical leave, our firm took on the case. After meeting with WP, we learned that he was hospitalized for 2 months and required 8 months of recovery. He needed regular visits to the clinic for wound care and ongoing hospital check-ups and physical therapy, during which he could not work.

With our assistance through legal proceedings, WP successfully claimed compensation for medical expenses, rehabilitation costs, and lost income due to his injuries.

Incident Overview:

At the time of the incident, the taxi and the medium truck were traveling eastbound on Lai Cheung Road at approximately 50 km/h. As they approached the intersection near Ferry Street, the taxi slowed down due to the traffic light turning yellow. The following medium truck failed to stop in time and crashed into the rear of the taxi. Both the taxi driver and passenger reported feeling unwell and went to a public hospital for treatment. The truck driver was subsequently found guilty of careless driving.

The taxi passenger, a college student with a regular part-time job, suffered a neck injury from the accident and required two months for recovery, during which they had to suspend their part-time job.

Legal Handling:

Upon receiving the case, our firm pursued compensation for the pain, suffering, and loss of enjoyment of life. However, the defendant’s insurance company questioned why the passenger did not seek immediate medical attention after the accident, claiming that the injuries were minor and refuse to provide reasonable compensation.

Current laws do not impose a strict timeline for seeking medical care after a traffic accident. It is reasonable for an injured person to seek treatment only after realizing their injuries.

After the passenger’s sick leave ended, with our assistance, they successfully obtained satisfactory compensation.

Incident Overview:

On the day of the incident, the light truck driver was heading north along New Filling Street and collided with a taxi traveling west along Shandong Street at the intersection. The collision caused severe damage to the front of the light truck and injured the male passenger’s head in the taxi. The taxi driver later admitted that although there was light rain making the road slippery at the time, and he failed to act as a qualified and cautious driver, stating that he misread the traffic light, which led to the accident.

Upon receiving the case, we learned that the client had suffered a serious head injury and required immediate treatment at the hospital, where seven stitches were needed on the right side of his forehead. We promptly contacted relevant government departments and both private and public institutions (such as the police, public hospitals, and social welfare department) to obtain all documents, reports, and evidence related to the case, ensuring that we provided the fastest and most timely service.

After reviewing the documents, we initiated a civil claim against the taxi’s insurance company. Initially, despite providing medical reports and various pieces of evidence, the insurance company remained unresponsive and dismissive, replying infrequently. Through persistent efforts, we continued negotiations with the insurance company, sending multiple letters without receiving a reasonable compensation amount.

Throughout this process, we maintained excellent communication with the client, understanding their concerns and urgency regarding the case. We ultimately secured a reasonable compensation for the client.
